Acceptable Use Policy

1. Purpose and scope

This Acceptable Use Policy ("policy") sets out what may and may not be done with Total Print Hub: the Design Studio, the Gang Sheet Builder, Instant Merch, Branded Stores, Production, and Inky AI, the Total Print Hub app for Shopify, the Total Print Hub plugin for WooCommerce, and our websites (together, the "service").

The policy is issued by Total Print Hub, Inc. ("Total Print Hub", "we", "us", "our"). Total Print Hub, Inc. is a corporation; all of its shares are held by ITLOX, Inc., a Delaware corporation. The policy forms part of the Terms of Service, and words defined there have the same meaning here.

The policy applies to merchants ("you") and to everyone who uses the service through a merchant's account or store: staff, contractors, shoppers, and connected integrations. It covers uploads, shared and private assets, designs, AI drafts, exports, and orders sent to suppliers.

2. General principles

  • Use the service only for lawful purposes, and in a way that does not infringe the rights of others or get in the way of other merchants' use of the service.
  • You are responsible for all activity under your account, and in the design tools and Branded Stores on your store, including the activity of your staff, your contractors, and your shoppers.
  • Do not impersonate any person or organisation, including Total Print Hub, and do not misstate who you are or for whom you act.
  • Do not help or allow anyone else to do what this policy forbids.

3. Artwork, designs, and products that are not allowed

3.1 Unlawful, counterfeit, and infringing products

You must not use the service to make, market, sell, reproduce, or distribute products or content that are unlawful, fraudulent, deceptive, counterfeit, infringing, exploitative, or dangerous.

You must have permission for every logo, font, artwork, photograph, trademark, name, likeness, supplier image, and other protected material that you or your shoppers submit. This includes the right to use a person's name or picture.

3.2 Harmful content

The following content is forbidden in uploads, designs, AI requests, and products:

  • child sexual abuse material, and any other content that exploits children;
  • intimate images of a person that were made or shared without that person's consent;
  • unlawful threats, targeted harassment, and content that incites violence or hatred;
  • sexual or violent content that is unlawful;
  • content that is defamatory or that invades another person's privacy;
  • instructions that help someone to cause serious harm; and
  • any other content that is illegal where it is made, sold, or delivered.

3.3 Your review

Review your shoppers' uploads and designs before you produce them. A shopper's confirmation that they hold the rights in a file, an AI draft, a preview, or a finished export is not a legal clearance. If you know or suspect that a design breaks this section, do not produce or sell it.

4. Files and data that must not be uploaded

You must not upload:

  • malware, executable code, tools that collect passwords, or scripts that are disguised;
  • drawings that carry scripts or other active content;
  • damaged or specially made archives that are meant to disrupt file scanning;
  • passwords, API keys, access tokens, or other secrets, including inside a design file;
  • payment-card data;
  • government identification numbers, health records, or other sensitive personal data; or
  • any other data that Total Print Hub is not designed to process.

Do not try to get around the checks that Total Print Hub makes on uploads, such as the checks of a file's type and size and the malware scan.

5. Security and the platform

5.1 Other merchants' data and the service's controls

You must not probe, list, reach, change, or work out another merchant's products, designs, customers, orders, assets, exports, credentials, supplier connections, or operational data.

You must not bypass sign-in, billing, usage limits, file scanning, the protected delivery of files, the rules on which products can be personalised, price checks, production approvals, or staff roles.

5.2 Attacks

You must not use the service, or act against it, to:

  • carry out or help an attack on a system or a network, such as a denial-of-service attack, port scanning, intrusion, or the mass testing of stolen passwords;
  • distribute malware, phishing pages, or other harmful software;
  • exploit a weakness in Total Print Hub or in another party's system, other than by reporting it to the party concerned;
  • test the security of our systems in a way that opens another merchant's data or disturbs the service;
  • reach, or try to reach, our systems or our administrative screens without authorisation; or
  • interfere with our hosting, our networks, or other merchants' use of the service.

5.3 Automation, scraping, and excessive use

  • Do not scrape Shopify, WooCommerce, suppliers, shared packs, our guides, or the service itself outside the interfaces that are meant for that purpose.
  • Do not create abnormal traffic, abusive export workloads, artificial accounts, false installations, or automated activity that materially degrades the service.
  • Integrations that we have approved must respect the limits and the retry guidance in our guides.
  • Keep within fair use. General file backup, hosting files that have nothing to do with print jobs, reselling our service or our storage, and automated abuse are outside fair use, as the Terms of Service explain.

5.4 Free trials, plans, and credits

  • Do not reinstall, reconnect, or open further accounts to obtain another free trial or a second monthly allowance of Inky AI credits.
  • Do not resell, white-label, or sublicense the service, and do not use it to build a competing product.

6. The design tools and Branded Stores on your store

The Design Studio, the Gang Sheet Builder, Instant Merch, and Branded Stores run on your store for your shoppers.

  • Purchases must go through the Shopify or WooCommerce checkout of your store. Do not bypass its payment or order steps.
  • Show your shoppers accurate prices, product information, and previews. Do not use the design tools or a Branded Store to mislead them.
  • Run the pages that your shoppers see in line with the age, parental-consent, and consumer-protection rules that apply to your store.
  • Do not enter a private Branded Store with an access code that was not given to you, and do not pass such a code to people it was not meant for.
  • You remain responsible for the rights in every upload, whatever confirmation text your store shows to the person who uploads.

7. Shoppers', suppliers', and production data

  • Use shoppers' and suppliers' data only for the order, support, fulfilment, or production purpose for which you hold it.
  • Do not export or combine that data for unrelated profiling, advertising, resale, surveillance, or decisions that discriminate against people.
  • Do not harvest or collect personal data about other people without a lawful basis, and do not use data from the service to send unsolicited commercial messages.
  • Supplier credentials that you save must be your own or be authorised for your business.

8. Inky AI and AI designer

These rules apply to Inky AI and to AI designer, the AI design help in the Design Studio (AI artwork, AI upscale, and design briefs).

You must not use an AI feature to:

  • ask for, make, or use output for content that this policy forbids, or for impersonation, fraud, infringement, or harmful deception;
  • make fabricated pictures of real people, false identities, or other material that is meant to deceive or to harm;
  • submit descriptions, prompts, pictures, or data that you have no right to use, including other people's protected names, logos, and artwork;
  • present AI output as checked, cleared, or made by a person where that would mislead someone;
  • make unlawful decisions about individuals; or
  • make the feature ignore its safeguards or act outside what your role and your plan allow.

You must also keep to these rules:

  • AI output is an editable draft. Review it for rights, accuracy, spelling, suitability, resolution, and printability before you publish or produce it.
  • Inky AI is for you and your staff. Do not give shoppers, or other people outside your business, access to it.
  • Do not try to get around the approval steps or the spending limits of Inky AI.
  • AI designer runs on the AI providers that we use and is paid from your Inky AI credits. Do not try to get around its switches or the limits that you set for it.

9. Our software and marks

You must not:

  • reverse engineer, decompile, or try to derive the source code of Total Print Hub, except where the law does not allow this restriction;
  • remove, hide, or change a copyright notice, a trademark, or another notice of ownership in the service or in our guides;
  • use our names, marks, or logos in a way that suggests that we endorse, sponsor, or are affiliated with you, without our written consent;
  • copy the service or make derivative works from it without a written licence from us; or
  • redistribute shared art, fonts, or templates as standalone files, or present them as owned exclusively by you.

This section does not limit what the open-source licence of the Total Print Hub plugin for WooCommerce allows for the plugin's own code. The DMCA & Intellectual Property Notice says which uses of our marks and content are permitted.

10. Account and access security

  • Do not share your sign-in details. Each member of your staff signs in with their own access and in the role that you gave them.
  • Do not try to reach another merchant's account or data.
  • Report a security incident, a weakness, or suspected use of your account by someone else to security@totalprinthub.com promptly.
  • Do not publish or exploit a weakness in Total Print Hub before we have had a reasonable time to fix it.

11. Store-platform rules

Your store runs on Shopify or WooCommerce. You must keep to the terms and policies of your store platform, of your payment provider, and of the suppliers and other services that you connect, including their rules on the products and content that may be sold. Where one of those rules is stricter than this policy, the stricter rule applies to your store.

12. Export controls and sanctions

You must not use Total Print Hub in breach of the export-control or sanctions laws that apply to you or to us. This includes using the service in, or for the benefit of, a country, territory, organisation, or person under sanctions.

You confirm that you are not located in, organised under the laws of, or controlled by the government of a sanctioned country, and that you are not on a sanctions list that applies.

13. Reporting a concern

If you learn of a breach of this policy, or find a security weakness in Total Print Hub, please tell us:

Do not put passwords, API keys, supplier secrets, or payment details in an email. To report an infringement of copyright or of a trademark, follow the DMCA & Intellectual Property Notice.

14. Enforcement

We may investigate a suspected breach of this policy. Where it is reasonably necessary to investigate abuse, protect another merchant, comply with the law, or prevent harm to the service, we may:

  • give a warning or require you to put the matter right;
  • reject, quarantine, restrict, preserve, or remove content;
  • limit a workflow;
  • suspend access to all or part of the service;
  • end your account, as the Terms of Service provide;
  • report suspected crime to the authorities and cooperate with them as the law requires; and
  • seek damages, an injunction, and legal costs.

Where reasonably possible, a suspension is limited to what the problem requires. For a measure against content or a workflow, we give you notice and a route to appeal through legal@totalprinthub.com where appropriate. If we suspend, restrict, or end your access, we give you our reasons in writing and you may appeal to the same address, as the Terms of Service set out. The Terms of Service also say when we may suspend or end access at once.

We end the accounts of repeat infringers in appropriate circumstances.

We are not obliged to monitor all use of the service, but we may do so to enforce this policy, to comply with the law, or to protect the service. The Refund and Cancellation Policy says what happens to fees when an account is suspended or ended because of a breach.

15. Changes to this policy

We may update this policy. We post the changed policy on this page with a new "Last updated" date. For a material change we give you at least 30 days' notice, by email or in the product, before it takes effect, as for a change to the Terms of Service.
