1. Scope of this disclaimer
This AI Disclaimer is issued by Total Print Hub Inc. ("Total Print Hub", "we", "us", "our"), the company that builds and operates the Total Print Hub service. Total Print Hub Inc. is a corporation; all of its shares are held by ITLOX, Inc., a Delaware corporation.
Our customers are merchants: businesses that run a Shopify or WooCommerce store and subscribe to Total Print Hub. In this disclaimer, "you" means the merchant and every person who uses the AI features on the merchant's behalf. A merchant's own customers are shoppers.
Total Print Hub has two AI features. This disclaimer applies to both of them, and to any other feature of Total Print Hub that uses artificial intelligence (together, the "AI features"):
AI designer: the AI design help in the Design Studio. It has three parts: AI artwork, which makes a picture from a typed description; AI upscale, which makes a larger version of an uploaded picture; and design briefs, which turn a typed description into a draft plan for a design.Inky AI: the assistant for a merchant's staff. It answers typed or spoken requests, prepares drafts, and carries out changes that an authorised person has approved. Inky AI is included in every plan.
"AI output" means everything that an AI feature produces: text, pictures, designs, plans, answers, figures, suggestions, and proposed changes.
A merchant that has switched AI designer on can offer it to its shoppers. Inky AI is for a merchant's staff and is not available to shoppers. This disclaimer is between the merchant and us. A shopper uses the Design Studio under the merchant's own terms, and the merchant is responsible to its shoppers for the AI features that it offers them.
This disclaimer forms part of the Terms of Service. Read it together with the Acceptable Use Policy, the Privacy Policy, and the Data Processing Agreement. By switching on or using an AI feature, you confirm that you have read this disclaimer and that you accept it.
2. The nature of AI output
The AI features work by finding patterns in data and estimating a likely result. They do not understand a request as a person does. As a result:
- AI output is not guaranteed to be accurate, complete, current, or fit for any purpose.
- AI output can look convincing and still be wrong. A picture can show something that nobody asked for, a text can state something untrue, and a figure can be miscalculated.
- AI output can contain or resemble existing works, brands, logos, characters, or real people, even when the request did not name them.
- AI output can be offensive, biased, or unsuitable for the people who see it.
- The same request can give different results at different times, and a similar result can be given to another user.
- A picture that an AI feature makes or enlarges can be too poor in quality to print, can differ in detail from the picture it was made from, and can contain misspelt or meaningless lettering.
- An AI feature can misunderstand a request, and a spoken request can be misheard. An AI feature, or the AI provider behind it, can also refuse a request or return no result.
- The AI models behind the AI features are made and trained by AI providers, not by us, on data from the past. They do not know your catalogue, your suppliers, your prices, or recent events unless that information is part of the request.
No AI system can be made free of error. We give no assurance that AI output is correct, original, lawful to use, or suitable for print.
3. AI designer: review before you sell or print
AI designer makes drafts. It does not make finished production art.
- AI output from AI designer is an editable draft. Review it for rights, accuracy, spelling, suitability, resolution, and printability before it is published or produced.
- Do not treat a low-quality picture as ready to print.
- A preview on a screen is not a colour-accurate physical proof. Before manufacture or fulfilment, check dimensions, colour, fonts, spelling, the print method, and the customer's approval, as the Terms of Service require for every design.
- Treat every picture from AI artwork or AI upscale as a draft until a person in your business has checked it and approved it for production.
- An accepted request, a finished picture, a preview, or a successful export is not a clearance of rights. Section 7 says who is responsible for rights.
3.1 Switching AI designer on
AI designer is off for your store until you switch it on. It sends a request to an AI provider only after you have switched it on, approved the use of data for it, and connected an AI provider account of your own. That provider bills you for the use. AI designer does not use Inky AI credits.
3.2 AI designer and your shoppers
You decide whether your shoppers can use AI designer, and whether and how much they pay for it. You are responsible to your shoppers for that charge, for what AI designer makes for them, and for the goods that you then print and sell.
Before your shoppers use AI designer, tell them that it uses artificial intelligence and that the description they type, or the picture they upload, is sent to an AI provider.
4. Inky AI: a person stays in control
Inky AI helps a merchant's staff. It does not replace their judgement. Inky AI works under these rules:
Reading and answering: Inky AI can look up information and answer a request without an approval. An answer can be wrong. Check it before you rely on it.Drafts: Inky AI prepares drafts within the consent and the spending limit that you have set.Changes that matter: publishing a product, changing a live price, replacing a saved design, or preparing production files needs an exact preview of the change and an explicit approval on screen by an authorised person. The approval covers only the change that was shown, and it lapses if it is not used within a short time.Not open to Inky AI: refunds, supplier purchase orders, releasing a job to production, direct control of a printer, deleting order history, sending messages to your customers without you, and changes to permissions, payment details, or billing.
Inky AI does not act without your approval where these rules require one. A spoken "yes" does not count as an approval. Inky AI cannot buy credits, raise its own spending limit, or approve its own work.
Before work that uses credits begins, you see the most credits that the work can use. The work never uses more credits than you approved. Credits are never bought automatically. A pack is bought only when the billing owner of the account confirms the purchase. The Terms of Service and the Refund and Cancellation Policy set out the rules for credits.
The person who approves a change is responsible for it. Read the preview before you approve. Give the right to approve only to members of staff who can judge the change.
Every feature of Total Print Hub can be used by hand, without Inky AI.
5. No professional advice
Nothing that an AI feature produces is:
- legal advice, including advice on whether a design infringes someone's rights, can be protected, or may lawfully be sold;
- tax, accounting, or financial advice, including advice on prices, costs, or margins;
- advice on product safety, labelling, or the rules that apply to the goods you sell;
- a production proof, a colour proof, or a supplier's confirmation of stock, price, or delivery.
Ask a qualified professional before you take a decision that depends on advice of that kind.
6. Human review and control
The AI features are built so that a person decides. AI designer gives drafts, and Inky AI asks for approval before a change that matters. You must:
- have a person review AI output before it is published, sold, printed, sent to a supplier, or used to change your store;
- make sure that the people who review AI output know enough about print production, and about rights in artwork, to judge it;
- keep your freedom to change, reject, or ignore AI output. You are never obliged to use it;
- not set up a process in which AI output is published, sold, or produced with nobody checking it;
- give access to the AI features, and the right to approve changes, only to members of staff you trust with them, and keep their accounts secure.
7. Rights in what goes in and what comes out
7.1 What goes in
You are responsible for the rights in everything that you or your shoppers put into an AI feature: descriptions, requests, uploaded pictures, logos, fonts, names, and product data. In particular:
- you must have permission for every logo, artwork, photograph, trademark, name, and likeness that is uploaded or described;
- do not ask an AI feature to copy or imitate a protected work, a brand, a character, or a real person unless you hold the permission that you need;
- do not request or use AI output for prohibited content, impersonation, fraud, infringement, or harmful deception. The Acceptable Use Policy applies to every request.
Each upload asks the person who uploads to confirm that they hold the rights in the file. That confirmation does not replace your own check. A check that an AI feature or an AI provider applies to a request is not a clearance of rights either.
7.2 What stays yours
As between you and us, you keep ownership of your content, including uploaded artwork and your shoppers' designs. We receive only the limited licence that the Terms of Service describe, which we need to run the service. We do not acquire ownership of your content.
7.3 What comes out
We claim no ownership of what the AI features make for you. Whether an AI-made design can be protected, and whether it is free of others' rights, depends on the law and on what was asked; we give no assurance of either.
- This disclaimer gives you no exclusive right in AI output. An AI feature can give the same or a similar result to another user.
- An AI provider's own terms can set conditions for what its models produce. For AI designer, the provider account is yours, and that provider's terms with you apply.
- Who owns a design as between a merchant and its shopper is decided by the merchant's own terms with the shopper.
The DMCA & Intellectual Property Notice explains how the owner of a right can report a design.
8. AI providers and your data
8.1 The AI providers
To run the AI features, we may use one or more of: OpenAI, Anthropic, Microsoft Azure, Amazon Web Services. We give notice before a new AI provider is added. The Subprocessors page lists the companies that process data for us and says how that notice is given. A merchant with an objection on data-protection grounds can write to dpo@totalprinthub.com before the change takes effect.
Each AI provider handles what it receives under its own terms. For the AI tools in the Design Studio, the provider account is the one the merchant connects, and that provider's terms with the merchant apply to the content. For Inky AI, we use provider accounts of our own. This disclaimer makes no statement about how long a provider keeps what it receives; that is a matter for the provider's own terms. An AI provider may process what it receives in a country other than the one in which your store's data is hosted. The Privacy Policy says more about transfers.
8.2 We do not train AI models on your content
We do not use your content, your shoppers' content or your requests to Inky AI to train AI models, and we do not build AI models of our own. We send content to an AI provider only to produce the result that was asked for.
8.3 What is sent to an AI provider
Design briefs: the typed description and the product's print-area context, which is a reference for the product setup, the names of the product's views, and the sizes and positions of its print areas. The provider can also receive the names and reference numbers of the artwork, fonts, and colours that the store has approved, but never the files.AI artwork: the description, rewritten as an instruction for a picture.AI upscale: the uploaded picture.Inky AI: the request of the member of staff, as text, together with the information from the store's account that the request needs. The rule for Inky AI is to send as little customer and order data as the request allows.
A request from the Design Studio identifies the store and the user only by coded references, not by name. No shopper name, email address, or order goes with a Design Studio request.
A description or a picture can itself contain personal data, for example a name in the text or a person in a photograph. Do not put personal data into a request unless you need it there and you are allowed to use it.
8.4 What we keep
For the AI tools in the Design Studio we keep a record of each run (a fingerprint of the request and of the answer, counts, usage figures and the provider's reference), not the description that was typed or the provider's text answer. Pictures that are made or upscaled are kept as the store's customer images.
Where an AI feature handles personal data of your shoppers, we act on your behalf, and you are responsible for the lawful basis and for the notices that your shoppers need. The Privacy Policy and the Data Processing Agreement say what personal data the AI features handle, how long it is kept, and what rights people have.
9. Your responsibilities under the law
Laws on artificial intelligence are developing. One of them is the Artificial Intelligence Act of the European Union (Regulation (EU) 2024/1689). You remain responsible for your own use of the AI features under the laws that apply to your business and to the places where you sell. In particular, you are responsible for:
- assessing the risks of the way you use AI output, in light of the goods you sell and the people you sell to;
- complying with the laws on artificial intelligence, consumer protection, advertising, intellectual property, and data protection that apply to you;
- telling your shoppers what the law requires them to be told, for example that a feature of your store uses artificial intelligence or that a design was made or changed with it;
- keeping the records that the law requires of you;
- telling us at legal@totalprinthub.com before you use an AI feature for a purpose that a law restricts or treats as high-risk. We may refuse that use.
The AI features are made for design work and for running a print business. Do not use them to take decisions about people, such as decisions on employment, credit, insurance, or access to a service, or for profiling, surveillance, or discrimination. We do not use the AI features to take decisions about people that have legal or similarly significant effects without a person being involved.
We give no assurance about how a law on artificial intelligence classes your use of the AI features.
10. Limits of our liability for AI output
To the fullest extent permitted by law, we are not liable for loss or damage, whether direct, indirect, incidental, or consequential, that arises from:
- reliance on AI output;
- errors, omissions, bias, or invented content in AI output;
- AI output that infringes someone's rights, or that cannot be protected;
- goods that were published, sold, produced, or shipped on the basis of AI output without the review that this disclaimer requires;
- a change that an authorised person approved after Inky AI showed it;
- an AI provider that is unavailable, or that changes or withdraws a model.
The AI features and AI output are provided "as is" and "as available", as the Terms of Service state for the whole service. These limits add to the disclaimer of warranties, the exclusions, and the cap on liability in the Terms of Service. They do not replace or reduce them. The Terms of Service also set out your responsibility to us for claims that others bring, including claims about designs that you sell.
Nothing in this disclaimer limits liability that cannot lawfully be limited, and nothing in it takes away a right that the law does not allow to be excluded.
11. Reporting a wrong or harmful output
If AI output is wrong, harmful, biased, offensive, or looks as if it infringes a right, tell us. Send an email to support@totalprinthub.com with the subject line "AI output report". Give the name of your store, what was asked, what the AI feature produced, and when. Do not put passwords, access keys, or payment details in the email.
- A report helps us to find and correct faults in the AI features. We do not use what you send in a report to train AI models.
- We take no action against a merchant, or against a member of its staff, because of a report made in good faith.
- Where an error of ours leaves you without a usable result from Inky AI, the credits that were used are put back. They are put back as credits, not as money. The Refund and Cancellation Policy says more.
- To report a design that infringes your rights, follow the DMCA & Intellectual Property Notice.
- To report a security weakness, write to security@totalprinthub.com.
12. Changes to this disclaimer
We may update this disclaimer when the AI features change, when an AI provider is added or changed, or when the law changes. The new version is published on this page with a new date and a new version number. Notice of a material change is given as the Terms of Service provide. If you keep using the AI features after the new version takes effect, you accept it. If you do not accept it, stop using the AI features.
